What Is Legal Aid?

The principle of legal aid ensures that individuals who are financially unable to bring a case retain the right to do so. Applicants whose requests are approved are exempt from court fees and other procedural costs, and attorneys appointed by the bar association provide representation and follow developments in the case free of charge.

Who Can Receive Legal Aid?

Anyone who cannot afford some or all of the costs required for legal proceedings—ranging from filing a claim to defense, protection requests, or enforcement actions—may be eligible for legal aid.

In addition, associations and foundations engaged in activities serving the public interest may receive legal aid for part or all of their legal costs if they are justified in their claims but unable to cover expenses.

Legal Aid Requirements

Legal aid requirements are determined after an interview with the applicant. Each application submitted to the relevant bar receives a document registration number and a file is opened for follow-up.

In addition to all information and documents supporting the merits of the request, the following may be requested:

  • Poverty certificate obtained from the local mukhtar
  • Document showing whether the applicant is registered with social security (SGK)
  • Records from Land Registry or Traffic Registration offices showing any registered property or vehicle in the applicant’s name
  • Copy of identity card
  • Proof of income: payroll for employees, pension booklet for retirees
  • Details of loan repayments if there are outstanding debts
  • Rental contract if applicable
  • Education certificate for children, if available
  • Details of the case file.

If the applicant obtains financial compensation as a result of the case, a declaration is signed committing to pay the bar association the attorney’s fee and five percent of the awarded amount.

How to Apply for Legal Aid

Applications for legal aid are made to the bar association serving the applicant’s region. The request is forwarded to the legal aid office or the appropriate representative. After the required documents are submitted, the application is reviewed. Only applicants who can demonstrate that their claim is justified will have their requests considered. After investigating the merits of the application, the bar issues a final decision.

If the legal aid request is submitted to the court where the case is being heard, the applicant must present a file that includes a summary of the claim and all necessary documents to the presiding judge. Cases initiated with a legal aid request are exempt from fees and taxes. The decision is usually issued without a hearing; however, if requested, it can be made following an oral hearing.
