Periods worked as a paid employee before turning 18 are combined with civil service periods and counted toward total retirement service time for civil servants; this combined total is used when determining retirement age groups. However, these under-18 service periods are not included in any adjustment (intibak) calculations.
For those who had service before October 2008, all service periods are treated as a single whole under the provisions of Law No. 2829, and retirement procedures are carried out based on the total accumulated service time.
For civil servants subject to Law No. 5434, it does not matter at what ages the periods worked in worker status occurred. If, while working as a worker, the person paid contributions to the Social Security Institution covering all insurance branches, those periods—even if worked under the age of 18—are combined with other service periods and included in the total service time when the person retires as a civil servant.
Relationship Between Civil Servant Retirement and SSK Entry
The start date of insurance does not carry significance for the retirement of civil servants. Therefore, for civil servants the insured employment start date does not affect the calculation of retirement age. Instead, total service up to 23/05/2002 is taken as the basis when calculating retirement age; the insured employment start date is not determinative.
Because insurance start is taken into account for workers when calculating age and retirement service, periods before turning 18 that are not counted as the insurance start may still be considered service time. For workers, insurance start dates before 1981 are also counted as such, while periods after that date may not be counted in the same way.
When determining the retirement age of civil servants, total service up to 23/05/2002 is the reference point; the date of first employment is not decisive. For those who apply for retirement after 8 September 1999 and who began working for the first time after that date, the retirement age is 58 for women and 60 for men.
Does Prior SSK Entry Benefit a Civil Servant?
For a civil servant who entered insurance in 2001, the retirement age calculation should be based on total service up to 23/05/2002. Periods of insured work before age 18 and periods of military service occurring before that date should also be included if they have been purchased (borçlanma). It is not possible to determine retirement age by referring back only to the insured employment start dates of 01/09/1989 or the date of turning 18 on 30/04/1990; therefore, the action taken by your Institution in such cases may be correct.
