How to Cancel a Bağ-Kur Restructuring Agreement

Bağ-Kur is one of the social security branches in our country. Citizens who fall under Bağ-Kur pay contributions to secure retirement rights and benefit from state-provided services such as healthcare at reduced costs. All matters related to Bağ-Kur are of direct interest to these insured persons. One important issue is how a Bağ-Kur restructuring (yapılandırma) can be canceled.

Bağ-Kur covers individuals who generally do not have the opportunity to work as salaried employees in the public or private sectors, such as tradespeople, craftsmen, village headmen (muhtars), and similar categories. These people pay contributions to Bağ-Kur and become eligible for retirement. Contribution amounts are calculated based on the minimum wage. Under Bağ-Kur, insured persons are covered for disability, old-age, survivor’s benefits, and health insurance. They may also receive a lump-sum payment to cover funeral expenses.

Sometimes Bağ-Kur contributors face difficulties in paying their premiums. To alleviate this burden, the government introduced an amnesty through a omnibus (torba) law that allows certain Bağ-Kur debts to be forgiven through restructuring.

The cancellation of a Bağ-Kur restructuring relates to the amnesty measures introduced by the omnibus law. Under this amnesty, eligible debts are erased. According to the provisions, people who have owed Bağ-Kur contributions for 12 months or longer may have those specified debts written off. Those who want to benefit from the amnesty must file an application under the terms of the omnibus legislation.

Who Can Have Their Debt Written Off Under the Bağ-Kur Amnesty

The following groups are eligible to have their debts cleared under the Bağ-Kur amnesty:

  • Those with contribution debt totaling 12 months or more.
  • Tradespeople and artisans.
  • Rural and agricultural Bağ-Kur contributors, such as farmers.
  • Individuals who have restructured their contribution debts or who apply to cancel a previous restructuring may also benefit from the amnesty under qualifying conditions.

The late interest added to Bağ-Kur contribution debts because of nonpayment is removed under the amnesty. This relief provides significant ease for many citizens, enabling those who struggle with payments to reorganize and regularize their obligations.

To benefit from the Bağ-Kur amnesty, eligible contributors must submit an application to restructure their debts. However, there are situations that can cause an existing restructuring to be voided. The law defines the following actions as violations of restructuring:

  • Having more than two restructuring installments unpaid or paid late within one year from the due date of the first installment.
  • Failing to pay, or paying late, more than two current (ongoing) monthly contributions within a single calendar year.

These conditions constitute restructuring violations under the law. When such violations occur, the restructuring is rendered void after the last day for payment of the third installment or the corresponding contribution. Additionally, contributors may themselves request cancellation of a restructuring by submitting a written petition to the institution to which they are affiliated.

Another common question among Bağ-Kur contributors is whether they can restructure their debts again, what happens to the premiums already paid under a restructuring, and whether social security services are affected when a restructuring is canceled.

If a contributor who previously restructured their debt fails to meet payment obligations, delays payments, and consequently loses the restructuring right, the amounts already paid under that restructuring remain credited toward the debt. In other words, installments paid as part of the restructuring are deducted from the outstanding debt even if the restructuring is later canceled.

The conditions for restoring payment capacity or reestablishing a restructuring after it has been canceled are as follows:

  • Within a calendar year, restructuring installments must not have been disrupted more than twice; in other words, installment performance should be kept within allowed limits.
  • There must be legally recognized evidence that current contributions were not paid due to hardship or compelling reasons as determined under the law.
