When Will Bağ-Kur Debts Be Erased?

There are several types of state-provided social insurance in our country. Bağ-Kur is one of these systems, covering many self-employed and freelance workers under the 4B category. Those registered with Bağ-Kur pay contributions to the state to access services such as retirement and healthcare. At times, contributors cannot pay their premiums on time or in full. In such cases, debt relief measures come into play. When Bağ-Kur debts will be erased is a common question.

As noted above, some Bağ-Kur participants fail to pay their required contributions promptly or completely. Since paying contributions is necessary to qualify for retirement, a Bağ-Kur premium debt amnesty provides relief for those who owe. With this type of debt forgiveness, individuals with outstanding Bağ-Kur premiums can have their debts reduced or restructured. The Bağ-Kur amnesty offers significant practical help to affected contributors.

Generally, individuals with unpaid Bağ-Kur contributions lose access to state-subsidized health and social services. Under a Bağ-Kur premium debt amnesty or write-off, indebted participants are offered payment accommodations so their access to subsidized services like healthcare is not interrupted.

Eligibility for Bağ-Kur premium debt forgiveness and write-offs requires meeting certain conditions. To qualify, a person must have been indebted to Bağ-Kur for more than two years. Those with more than two years of arrears are granted a three-month window during which their debts can be restructured. Once restructuring is completed, a repayment schedule begins for the reorganized obligations.

For Bağ-Kur contributors with arrears exceeding two years, the amnesty provision can result in the erasure of certain debts; however, erased debts are often tied to the removal of related service records. These erased service credits can be reinstated within a specified period if the individual pays the outstanding debt for those service periods. That allows contributors who need additional premium days for retirement to restore their service record and regain eligibility for retirement when they meet the required contribution days.

The omnibus law that introduced this Bağ-Kur amnesty also enables insurance consolidation. Individuals who have previously completed insurance periods remain protected by their assigned social security institutions. When a person subject to different coverages consolidates insurances, the selected coverage applies from the earliest chosen entry point, and the corresponding rights are preserved.

According to the omnibus law’s Bağ-Kur amnesty, provisions were also made for people who already receive a Social Security Institution (SGK) retirement pension but have opened a new business under the tradesman category and failed to pay the new premiums. Those who start a new workplace must apply to the Social Security Institution within three months to benefit from the Bağ-Kur amnesty introduced by the omnibus law. This allows their existing debts to be restructured.

The basic principle behind Bağ-Kur debt write-off is the removal of late interest accrued on accumulated arrears. The state does not erase the principal outstanding debt when restructuring payments. Instead, the restructuring process typically cancels the delay interest and penalties that were added to the original debt over time, making repayment more manageable for the debtor.

Who Can Have Bağ-Kur Debt Written Off?

Not everyone qualifies for the Bağ-Kur amnesty under the omnibus law. The following groups may benefit from Bağ-Kur debt write-off and amnesty provisions:

  • Those with unpaid contributions to the state for 12 months or longer.
  • Tradespeople and craftsmen.
  • Agricultural and farmer Bağ-Kur participants.
  • Individuals whose premium debts were previously restructured or who have applied to cancel a prior restructuring can also benefit from this Bağ-Kur debt write-off.
