Which Monthly Pensions Are Paid Under Law No. 2022?

Pensions granted under Law No. 2022 include the following categories:

  • Old-age pension (for those over 65).
  • Disability pension (for those over 18 with a disability rate between 40% and 69%).
  • Care-dependent disability pension (for those over 18 with a disability rate of 70% or more).
  • Pension for a relative caring for a disabled person (for caregivers of disabled persons under 18).

Thus, four types of pensions are provided.

Applicants who meet the eligibility criteria must apply in person with their Turkish ID card (T.C. identity card) to the nearest Defterdarlık or Malmüdürlük office at their place of residence.

The date payments begin is the first day of the month following the date the submitted documents are registered at the Defterdarlık or Malmüdürlük. Payment dates each month are determined according to the last digit of the recipient’s birth date. The pension amount may increase or decrease depending on regulations.

Old-age Pension under Law No. 2022

This pension is paid to those who have reached age 65, have no one legally responsible for their care, and have no income. To receive an old-age pension, applicants must document their neediness. The requirements for application are:

  • Must be a Turkish citizen.
  • Must be 65 years of age or older.
  • Must have no one legally obligated to care for them.
  • Must not be receiving a pension from social security institutions.
  • Their income must be below the poverty/neediness threshold.
  • Must apply in person with their Turkish ID card to the relevant office.

The pension amount is paid quarterly at a total of 784.65 TL. The monthly equivalent is set at 261.54 TL.

Disability Pension under Law No. 2022

This pension is for persons over 18 and under 65 who have a disability rate between 40% and 69%. To be eligible, applicants must be unable to work and have no one to care for them. They must not receive any pension or alimony from social security institutions. The disability must be documented by a medical report issued by an authorized health institution. Applicants who do not meet these conditions are unlikely to receive the pension. Key requirements include:

  • Must be a Turkish citizen.
  • Must be older than 18 and younger than 65.
  • The disability degree must fall within the specified range.
  • Must have no other income.

Applications are made in person with a Turkish ID card and required documents at the nearest Defterdarlık or Malmüdürlük. This pension is paid at 200% of the neediness threshold. It is disbursed quarterly at 1,247 TL, which equals 451.67 TL per month.

Care-dependent Disability Pension under Law No. 2022

This pension is granted to those with a disability degree of 70% or more who cannot maintain their lives without assistance. To benefit from this pension under Law No. 2022, applicants must meet the following conditions:

  • Have no legally responsible person to care for them,
  • Not receive a pension from a social security institution,
  • Not receive alimony,
  • Have no continuous income,

The disability degree and need for care must be certified by a medical report from an authorized health institution. Applications are made in person with a Turkish ID card and the necessary documents at the nearest Defterdarlık or Malmüdürlük. This pension is paid at 300% of the neediness threshold. It is disbursed quarterly at 1,845 TL, which corresponds to 615 TL per month.

Pension for a Relative Caring for a Disabled Person under Law No. 2022

To be eligible for the caregiver’s pension under this law:

  • Must be a Turkish citizen.
  • The disabled person being cared for must be under 18 years old.
  • The caregiver must be providing actual, day-to-day care for the disabled person.
  • The caregiver must not receive income or a pension from social security institutions.
  • Must not receive alimony.
  • Must have no other income.
  • Income must be below the neediness threshold.
  • The neediness must be documented by the relevant authorities.

To apply, the caregiver must submit their Turkish ID card and required documents in person to the nearest Defterdarlık or Malmüdürlük. This pension is paid at 200% of the neediness threshold. It is disbursed quarterly at 1,059 TL, equivalent to 353 TL per month.

Payments and Differences under Law No. 2022

  • Differences between previously received disability pensions and the amounts determined under Law No. 2022 are paid as arrears where applicable.
  • Because these payments are made as differences, they are not a fixed amount but calculated and paid as monthly differences. To receive a difference payment, the following apply:

– Being a Turkish citizen is the primary requirement.

– The person entitled to the difference must be disabled or an orphan.

– The disability must be documented by a medical report from an authorized health institution.

– There must be a difference between the previously received pension and the amount established under Law No. 2022.

Suspension and Cessation of Pensions under Law No. 2022

A pension may be suspended or terminated if the recipient or the person responsible for their care experiences any of the following situations:

  • Death of the recipient or the person responsible for care,
  • Loss of Turkish citizenship,
  • The recipient’s neediness ceases,
  • Another person assumes the care responsibility,
  • The disabled person begins working,
  • For caregiver pensions: the disabled person turns 18,
  • For caregiver pensions: it is determined that the caregiver is not actually providing care.

In such cases, the pension payments are discontinued.
